These Terms and Conditions set out the basis on which Rubbish Clearance Ilford provides rubbish removal, waste collection and related clearance services. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions shall have the meanings set out below:

1.1 Service Provider, we, us or our means Rubbish Clearance Ilford, the business providing rubbish clearance and waste collection services.

1.2 Customer, you or your means the person, company or organisation ordering or receiving the services from us.

1.3 Services means any rubbish removal, waste collection, clearance, loading, transport, recycling or disposal services that we provide to you.

1.4 Booking means any order or request by you for services, whether made by telephone, email, online form, or in person, which is accepted by us.

1.5 Waste means any items, materials, rubbish or refuse you ask us to remove, including household waste, commercial waste, bulky items, garden waste and similar materials, but excluding any prohibited waste as set out in these Terms and Conditions.

2. Scope of Services

2.1 We provide waste removal and rubbish clearance services, including collection, loading, transport and lawful disposal or recycling of eligible waste from residential and commercial premises.

2.2 The specific services to be provided will be agreed at the time of booking, based on information you supply about the waste type, volume, access arrangements and service address.

2.3 Any descriptions, photographs or estimates given prior to the service are for guidance only and do not form a binding commitment as to the final scope of the services. The final scope and price may be adjusted on site if the actual waste differs from the description provided.

3. Booking Process

3.1 You may request a booking by contacting us via telephone, email or our online enquiry systems. You must be at least 18 years old and legally capable of entering into a binding contract to place a booking.

3.2 When submitting a booking request, you must provide accurate and complete information, including your name, contact details, service address, access details, description and approximate quantity of waste, and any relevant time constraints.

3.3 We will review your request and, where possible, provide a provisional quote and proposed service date and time window. A booking is only confirmed when we explicitly accept it and provide you with a confirmation by telephone, email or text message.

3.4 We reserve the right to decline any booking request at our sole discretion, including where the waste is unsuitable, access is unsafe, or we do not have capacity on the requested date.

3.5 You must notify us as soon as possible of any changes to your booking details. Changes may affect the price, timing and feasibility of the services and are subject to our agreement.

4. Access and Customer Obligations

4.1 You agree to provide safe, reasonable and timely access to the premises and waste that we are required to collect. This includes ensuring that any gates, doors, parking areas, lifts and access routes are available during the agreed time window.

4.2 You must ensure that the waste is clearly identified and separated from any items that you do not wish to be removed. Our team may ask you to confirm what should and should not be taken before loading.

4.3 If access to the premises is restricted, unsafe or significantly different from what you described when booking, we may need to adjust the price or time required, or in some cases refuse to carry out part or all of the services.

4.4 You are responsible for obtaining all necessary permissions, permits or authorisations for us to access your property or shared areas in order to carry out the services.

5. Pricing, Quotations and Additional Charges

5.1 Prices for our services are generally based on the volume, weight, type of waste, labour required and any additional services requested, such as dismantling or extra loading time.

5.2 Any quotation provided before arrival is an estimate only, based on the information you have given. The final price will be confirmed on site after our team has inspected the waste and access arrangements.

5.3 If the actual waste is more than described, includes prohibited items, or access is significantly more difficult than stated, we may offer a revised price. If you do not accept the revised price, we may cancel the service in accordance with these Terms and Conditions.

5.4 Additional charges may apply for: extended waiting time where our team is kept waiting beyond a reasonable period; extra labour where waste is difficult to access or requires extensive manual handling; or late changes to booking time slots.

6. Payments and Invoicing

6.1 Unless otherwise agreed in writing, payment is due on completion of the services, prior to our team leaving the site. We may require part or full payment in advance for certain bookings.

6.2 We accept payment by cash, debit card, credit card or bank transfer, subject to the methods available at the time of service. We reserve the right to refuse certain payment methods for operational or security reasons.

6.3 For commercial customers, we may agree to issue invoices with specified payment terms. Invoices must be paid in full by the due date stated. We may conduct credit checks and adapt payment terms at our discretion.

6.4 If payment is not made when due, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in seeking payment.

7. Cancellations and Rescheduling

7.1 You may cancel or reschedule your booking by contacting us during our normal business hours. We ask that you provide as much notice as possible so we can manage our schedule efficiently.

7.2 If you cancel more than 24 hours before the agreed arrival time, no cancellation fee will normally apply, unless we have incurred specific costs on your behalf which we will notify to you.

7.3 If you cancel within 24 hours of the agreed arrival time, fail to provide access, or are not present where your presence was required, we may charge a reasonable cancellation or call-out fee to cover our costs.

7.4 We may cancel or reschedule your booking at any time if we are unable to provide the services for reasons beyond our reasonable control, including severe weather, vehicle breakdown, staff illness, road closures or safety concerns. Where possible, we will offer an alternative time. We will not be liable for any losses arising from such cancellations, other than refunding any payments you have made for services not provided.

8. Waste Regulations and Prohibited Items

8.1 We operate in accordance with applicable UK waste management laws and regulations, including duty of care requirements and licensing obligations for the transport and disposal of controlled waste.

8.2 We will only collect waste types that we are legally permitted and equipped to handle. We do not accept hazardous or specialist waste, which may include but is not limited to: asbestos, chemicals, solvents, medical waste, clinical waste, pressurised containers, gas bottles, certain types of batteries, and liquids such as oils, fuels or paints in non-compliant containers.

8.3 If we discover prohibited items within your waste, we may refuse to collect them, charge additional fees for handling, or decline to proceed with the service. You remain responsible for any prohibited items unless we expressly agree in writing to remove them.

8.4 We will take your waste to authorised transfer stations, recycling facilities or disposal sites. We aim to minimise landfill use and to recycle or recover materials where reasonably practicable.

8.5 You confirm that you have the right to give us the waste for removal and that the waste does not include any items belonging to third parties without their consent.

9. Customer Responsibility for Waste Description

9.1 You are responsible for ensuring that the description of the waste provided to us before collection is accurate and complete. This includes identifying any items that could be hazardous, fragile, bulky or unusually heavy.

9.2 If the waste is found to be materially different from the description you provided, we may revise the price, adjust the service, or refuse to collect all or part of the waste.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in providing our services. However, we shall not be liable for any loss or damage that is not reasonably foreseeable or that is caused by factors outside our reasonable control.

10.2 You must notify us of any damage you believe was caused by our team as soon as reasonably possible, and in any event within 48 hours of completion of the services, so that we can investigate.

10.3 We will not be liable for any pre-existing damage to your property, fixtures or fittings, or for wear and tear or deterioration that occurs in the normal course of moving and handling waste where reasonable care is taken.

10.4 We shall not be liable for any indirect or consequential losses, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the services.

10.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

11. Insurance

11.1 We maintain appropriate insurance in connection with our operations, including public liability insurance at a level we consider reasonably adequate for the nature of our services.

11.2 The existence of insurance does not extend or increase our liability beyond the limits set out in these Terms and Conditions, except where required by law.

12. Data Protection and Confidentiality

12.1 We collect and use your personal information for the purpose of managing your booking, providing the services, processing payments, and communicating with you about your service.

12.2 We will handle your personal information in accordance with applicable data protection laws and use reasonable measures to keep it secure.

12.3 We will not sell your personal data to third parties. We may share your information with our employees, contractors and service providers where necessary to deliver the services or comply with legal obligations.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of our services, please contact us as soon as possible with full details of your concern so that we can seek to resolve the issue.

13.2 We will review your complaint, investigate where necessary and respond within a reasonable time, usually by proposing a remedy or explanation.

13.3 If a dispute arises that cannot be resolved informally, both parties agree to attempt to resolve it through negotiation before commencing legal proceedings.

14. Amendments to These Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our services, legal requirements or business practices.

14.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time you make the booking, unless we agree otherwise with you in writing.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any non-contractual obligations arising out of or in connection with them, are governed by and shall be construed in accordance with the laws of England and Wales.

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.
